I'm sure you're right, but that's not a legal defense, you know?

Even if you're not making anything off of it, companies can sue based on the premise that you're drawing business away from them in the form of lost sales etc.

Regardless, I don't think anyone's gonna care if you put up your cover song.
There are 10 types of people in the world.

Those who understand binary. . .

. . .and those who don't.

Depending who owns the rights to the song, you might have troubles. What might prove tricky is getting it past the screeners at cd pressing plants and cdbaby (for the iTunes loving).

I think you'll be fine. We posted our cover of 'Hit Me Baby One More Time' on MySpace for about 6 months a while back, and Britney never sued us. According to the MySpace TOS you have to legally own the rights to any music you upload to your site, but they never go through and check it. If someone decided to get crazy and report you, MySpace would make you take it down (I've heard rumors that Tom threatens to come and break you kneecaps). Outside of that I don't think you'll have any trouble.

Technically it's copyright infringement, but you'll probably never get caught.

Just to be safe though, you might want to know what size handcuffs you wear in advance. And I hear kneepads are good to have in the joint. But don't worry, nothing will happen. Yeehaa

if he belongs to the music union they might come after you for royalties but that's if they catch it, from what I understand they're more about listening to radio and making sure that you get paid your 7 cents a minute royalty for air play
