10-Year sentence thrown out in teen sex case.

I read about this case a while back and then bassjones (I think?) posted something here about it. Well, the kid's case was thrown out and he's out of jail now.
It's a shame that it ever happened but it's good to see someone came to their senses.

Thank God....I really have to wonder what that prosecuting attorney was thinking. Was he ever indicted by a grand jury, or just the prosecutors office?

That is just horrible. Glad to see the kid is gonna get out.....hopefully. I would be serving consecutive life sentences for some of the stuff I did as a minor!

It's up the the prosecuting attorney, and if he thinks a BJ is worth ten years in jail.
There is a reason why these people are voted in, vote their asses out or start a recall election.

I'm just sitting here shaking my head...I don't know the details of the case, but did both the boy and girl agree this was consensuel and he was still thrown in jail? Was it the parents of the girl that were pursuing this? Just curious.

I remember it back when it happened they had a 48 hours on it or something...LAME to say the least...
Why wasn't the girl thrown in jail too then? She is the one that 'performed' on him...
Some prosecutors have nothing to do with their time apparently...like going after 'criminals'.
Good to see an actual JUDGE saw through this crap and did he right thing...

From what I recall there was nothing 'forced'. They were both 'consenting' therefore charges should have been brought on her exactly the same as was brought on him.
There isn't a gender twist to this either. If she was his age and he was her age and he went down on here and she was charged then he should have been charged the same...
They BOTH performed some level of sexual activity on someone that is legally considered a minor...and each with the same 'consent'.

I think what bwohlgemuth was trying to say was that in these situations the male by stereotype is labeled as the "agressor" whilst the female is labled as the "victim"
for example, in domestic disputes, the female can even be the one who physically harms the male but the male ends up in jail over it.
or
in a seperation the female can be strung out on crack but the job holding male loses custody of the child
happens all the time.

in Michigan they both go to jail and then the judge will hear both sides and try to determine the aggressor.

I guess my question was more, who took this to court? I mean, I agree with the whole stereotype thing and it is a bunch of BS. But, if the girl was consenting and the boy was consenting, how did it get to the court system? Did someone randomly see the video? Did the parents of one of these kids pursue the legal action?
Even in michigan, "someone" has to bring it to the authorities...consenting or not, someone has had to complain to bring attention to it...

If I recall it was HER parents that started the whole ordeal....BUT....once there is evidence out there nobody but the prosecutor has to bring it to court. The law can pursue regardless of a complaint.
